Terms of Use

These Terms govern your use of Utter, the voice-forward to-do list app under the dailyworks.app brand.

1. Acceptance of Terms

By using Utter, you confirm that you have the legal capacity to enter into these Terms, you agree to comply with all applicable laws and regulations, and you accept these Terms in their entirety.

2. Description of Service

Utter is a privacy-focused voice-first to-do list application designed to help users create and manage to-do lists using voice or typing, track shopping lists in a dedicated Grocery mode, capture free-form thoughts on a Brain Dump canvas, focus on one task at a time in Deep Focus mode, have tasks read aloud in Drive Time mode, save and restore list snapshots, and hear tasks read back using text-to-speech.

Voice Processing

All speech recognition happens on your device using Apple's on-device Speech framework. Your voice is never sent to any server.

Data Storage

All your tasks, thoughts, and settings are stored locally on your device. No personal information is collected, stored, or accessed on any servers.

Not AI-Powered

Utter uses rule-based keyword matching to route tasks between modes. It does not use AI, large language models, or any cloud-based processing.

3. Subscription Terms

3.1 Free Trial

New users are eligible for a 7-day free trial with full access to all features. You will not be charged during the trial period. No payment method is required to start the trial.

3.2 Subscription Plans

After the free trial ends, continued access requires one of the following:

All plans unlock identical full access to Utter's features. Prices are in GBP and may vary by region. Prices are subject to applicable taxes.

3.3 Billing and Renewal

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage your subscription in your Apple ID Account Settings after purchase

3.4 Cancellation

You may cancel your subscription at any time through your Apple ID Account Settings (Settings → [Your Name] → Subscriptions). Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial subscription periods. The Lifetime Purchase is a one-time payment and is not subject to cancellation.

3.5 Refund Policy

All purchases are processed through Apple's App Store and are subject to Apple's refund policies. To request a refund:

  1. Visit reportaproblem.apple.com
  2. Sign in with your Apple ID
  3. Find your purchase
  4. Select "Request a refund"

4. User Responsibilities

4.1 Prohibited Uses

You agree NOT to:

  • Share your account credentials with others
  • Reverse engineer, decompile, or disassemble Utter
  • Use Utter for any unlawful purpose
  • Attempt to gain unauthorised access to any portion of Utter
  • Remove or modify any copyright or proprietary notices
  • Use paid features without a valid subscription or purchase

4.2 Content You Create

You are solely responsible for the content of the tasks, lists, and thoughts you create in Utter. Since all content is stored locally on your device and never transmitted, there is no visibility into or responsibility for the content you create.

5. Reminder and Reliability Disclaimer

Important Warning

Do not rely solely on Utter for time-critical tasks. Always maintain backup reminder systems for anything important.

Technical failures can occur due to:

  • Device battery depletion
  • iOS system failures
  • App crashes or bugs
  • Device restarts or updates
  • Do Not Disturb or other system settings
  • Speech recognition errors due to background noise or accents

6. Your Data and Privacy

6.1 Data Ownership

You retain complete ownership of all data you enter into Utter. Your data is stored locally on your device.

6.2 Data Export

You may share your lists at any time using the iOS Share Sheet, which generates shareable text directly on your device.

6.3 iCloud Backup

If you enable iCloud backup (optional), your data will be stored in your personal iCloud account subject to Apple's iCloud Terms of Service.

6.4 Privacy Policy

Collection and use of information is governed by the Privacy Policy at https://dailyworks.app/privacy.

7. Intellectual Property

Utter, including all content, features, and functionality, is owned by Peter Hunter and is protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use Utter for personal, non-commercial purposes in accordance with these Terms.

8. Limitation of Liability

  • Not liable for any indirect, incidental, special, consequential, or punitive damages
  • Not liable for consequences resulting from use of Utter, including missed tasks or forgotten items
  • Not liable for data loss — please maintain your own backups where necessary
  • Not liable for app failures, notification issues, or user error
  • Total liability shall not exceed the amount paid in the 12 months preceding the claim

Some jurisdictions (including the UK under the Consumer Rights Act 2015) do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you. Nothing in these Terms affects your statutory rights as a consumer.

9. Disclaimer of Warranties

Utter is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, uninterrupted or error-free operation, or the accuracy of voice recognition.

10. Updates and Modifications

The right is reserved to:

  • Modify, suspend, or discontinue any aspect of Utter at any time
  • Update these Terms at any time with notification of material changes
  • Change subscription pricing with 30 days' notice to existing subscribers
  • Release updates, bug fixes, and new features

Continued use of Utter after changes constitutes acceptance of the modified Terms.

11. Termination

11.1 Termination by the Developer

Access to Utter may be terminated or suspended at any time, with or without notice, for violation of these Terms. Upon termination, your right to use Utter will immediately cease. Your local data remains on your device.

11.2 Termination by You

You may stop using Utter at any time by uninstalling it and cancelling your subscription through Apple ID Account Settings.

12. Third-Party Services

Utter integrates with Apple's services including:

  • Apple App Store (for purchases)
  • iCloud (for optional backups)
  • iOS Speech Recognition framework (on-device only)
  • AVFoundation (for audio and text-to-speech)
  • StoreKit 2 (for subscription management)

Use of these services is subject to Apple's applicable terms and policies.

13. Indemnification

You agree to indemnify and hold harmless the developer of Utter from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of Utter, your violation of these Terms, or your violation of any rights of another party.

14. Governing Law and Disputes

14.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

14.2 Dispute Resolution

Any disputes shall be resolved in the courts of England and Wales. For subscription disputes, you also have the right to use Apple's dispute resolution process.

14.3 Consumer Rights

Nothing in these Terms affects your statutory rights as a UK consumer under the Consumer Rights Act 2015, including:

  • Rights to refunds for defective digital content
  • Right to cancel distance sales within 14 days
  • Protection against unfair contract terms

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

For users who download Utter from the Apple App Store, you acknowledge that:

  • These Terms are between you and Peter Hunter, not Apple
  • Apple has no obligation to provide support for Utter
  • Apple is not responsible for any claims relating to Utter
  • In the event of any third-party intellectual property claim, the developer is responsible for investigation and defence
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the developer of Utter and supersede all prior agreements and understandings.
